If your child has been the victim of cyberbullying, you do have the right to bring a lawsuit on their behalf. Cyberbullying is any bullying that takes place via the internet or text messages.
For example, bullying on Instagram, on Facebook, Snapchat, or in emails. This is a frequent occurrence in schools and we're finding more and more that it's usually done between students that go to the same school. Because of that, New York has enacted a number of laws that require schools to adequately teach students to avoid cyberbullying and to also respond to cyberbullying, even if it doesn't occur within the school.
If you feel that your school has not properly responded to cyberbullying and that your child has been seriously affected by it, you have the right to sue the school, the administrators, and you may have federal rights under the civil rights law depending on the nature of the bullying.
