My name is Patrick Collopy, and I'm an employment attorney.
All employees, regardless of their citizenship, are covered by the protections of the federal Fair Labor Standards Act, are eligible to receive the same minimum wage and overtime pay as provided by law. Certain cities and states also protect against pay discrimination, make it illegal for employers to discriminate against workers based on their citizenship status.
For example, in New York City, your employer may not pay you less than other employees simply because you do not possess a social security card.
If you were paid differently than other employees because you were not a United States citizen, or if you believe you are not being paid correctly, we encourage you to contact an attorney experience and employment litigation as soon as possible.
