On July 24, 2023, Judge Beth Phillips of the Western District of Missouri denied J.M. Smucker’s motion to dismiss a consolidated multidistrict litigation complaint in the matter In Re: Folgers Coffee Marketing Litigation, No. 4:21-md-02984-BP. Plaintiffs, represented by Faruqi & Faruqi as co-lead counsel, allege that J.M. Smucker falsely advertises certain Folgers ground coffee products as being capable of making “up to” a specific number of servings when they cannot.
This is Defendants’ fourth failed effort to dismiss this case.
