Here are some personal injury deadlines in New York that you should know about:
3 years - That’s the statute of limitations for most personal injury cases in New York. In New York, you have three years from the date of your incident to file your claim. CPLR §214.
2 ½ years – The medical malpractice statute of limitations in New York. You have two and a half years from the date of the incident (or the last time you sought treatment) to file a claim in New York. CPLR §241-A.
2 years – That’s how long you have to file a personal injury claim in New York if your case involves the death of a loved one. In New York, you have two years to file a cause of action for wrongful death. EPTL §5-4.1.
90 days – If you were injured due to the negligence of the government or municipality in New York, you must file a notice of claim within 90 days of the occurrence.

YOU CAN BRING A PERSONAL INJURY CLAIM IN NEW YORK EVEN IF YOU MAY BE PARTIALLY AT FAULT
If you think you may partially at fault for the incident, you still have the legal right to bring a personal injury action in New York if someone else negligently caused you harm. Under New York law, even if you’re at fault, there will be a determination of the percentage of fault between you and the other negligent party. For example, 50%/50%, 75%/25%, etc. CPLR §1411.
NON-CITIZENS CAN FILE A PERSONAL INJURY LAWSUIT
Your immigration status has no effect on your ability to bring a personal injury lawsuit in New York. The law in New York is clear – you are entitled to bring a claim whether you are or aren’t a citizen. You have the same rights as anybody else who gets hurts.
TO BRING A PERSONAL INJURY CASE THERE NEEDS TO BE NEGLIGENCE

Negligence is the failure to behave with the level of care that someone of ordinary prudence would have exercised under the same circumstances.
