On October 12, 2021, plaintiffs filed a motion for preliminary approval of a class action settlement reached with defendant Godiva Chocolatier Inc. (“Godiva”). The settlement is valued at over $20 million, and seeks to resolve allegations that Godiva engaged in false and deceptive practices. Specifically, consumers alleged that Godiva led consumers to believe that certain Godiva products were made exclusively in Belgium, when in fact, they were not.
The settlement represents a major victory for consumers. Indeed, Godiva has agreed to pay up to $15 million for all valid claims submitted, in addition to up to $5 million in attorneys’ fees and costs, and $550,000 for administering the settlement. For Godiva, the settlement will end two years of hard-fought litigation, which included an intensive and costly investigation of the allegations and a failed attempt to have the case dismissed.
