Faruqi & Faruqi Defeats Motion for Interlocutory Appeal In Securities Class Action

On March 23, 2020, Judge Richard F. Boulware, II of the District of Nevada denied Defendant Tahoe Resources’ motion to certify for interlocutory appeal the Court’s June 19, 2019 order denying Defendants’ motion to dismiss.  The Court held that the issues Defendants sought to certify were not the proper subjects of interlocutory appeal because, inter alia, they were neither raised nor addressed at the motion to dismiss stage, did not involve novel legal issues, and were nothing more than a disagreement with the application of undisputed legal standards.
