My name is Patrick Collopy and I'm an employment attorney.
Generally, under federal and state law, your employer is required to pay you for every minute that you work. This means that if you're scheduled to work from 9:00 AM until 5:00 PM and end up working from 9:00 AM until 5:05 PM, your employer must pay you for working the extra unscheduled five minutes as well. Under certain circumstances, your employer may be allowed to round the time down to the nearest hour. However, your employer must round time in a way that is fair to you. This means that your employer is not allowed to round your time in a way that always favors the company.
If you believe that your employer has improperly rounded the time that you work or your employer is not paying you correctly, we encourage you to contact an attorney experienced in employment litigation as soon as possible.
