Faruqi & Faruqi, LLP Seeks to Recover Damages on Behalf of DaVita HealthCare Partners Inc. and its Shareholders (DVA)
Faruqi & Faruqi, LLP, a national law firm concentrating on investor rights, consumer rights and the enforcement of federal antitrust laws, is investigating potential wrongdoing at DaVita HealthCare Partners Inc. (“DaVita” or the “Company”) (NYSE: DVA). The investigation focuses on whether certain officers and directors of DaVita violated their fiduciary duties to the Company and have damaged DaVita by, among other things, causing the Company to engage in Medicare fraud from at least 2003 through 2010.
DaVita is a provider of Kidney care in the United States, delivering dialysis services to patients with chronic kidney failure and end stage renal disease. On July 25, 2011, the Company became the subject of a whistle-blower lawsuit alleging that it submitted fraudulent claims for Medicare reimbursement in violation of the False Claims Act. In particular, the Company is accused of fraudulently manipulating medication administration procedures, including dosage and vial combination, to increase the unnecessary waste of certain dialysis medications and obtain otherwise non-reimbursable charges. For example, the Company is alleged to have used larger than necessary vials of medicine knowing that Medicare would pay for the unused portion of each vial if it were deemed unavoidable waste. The Company now faces potential liability for overbilling the government as much as $800 million. Shareholders interested in seeking to recover damages on behalf of DaVita and to implement corporate governance measures designed to prevent future misconduct should contact Faruqi & Faruqi, LLP.
